Terms of Service
The agreement between you and Aish about using the app

These terms (the "Agreement") apply between you and SmartThings LLP, a company registered in the Republic of Kazakhstan (details at the end of this document, "we", "Aish"), whenever you use the Aish mobile app, the website aish-talk.com, and related services. By installing or using the app, or by buying on the website, you accept the Agreement together with the Privacy Policy, the Refund Policy, and the Cookie Policy.
1. What Aish is
Aish is an AI-powered voice companion. You tell your dream, Aish asks questions, and at the end of the conversation she creates a result: a picture, a comic, a video, or a written reflection. Results are saved to the dream journal inside the app.
Aish does not provide medical, psychological, psychiatric, or any other professional help. A dream reflection is an entertaining and educational text generated by a model, not by a specialist. It is not a diagnosis, a treatment recommendation, or a prediction. If you are worried about how you feel, see a doctor or a therapist. If your life is in danger, call emergency services.
2. Account
- You must be at least 16 to use the app. If you are younger, do not install it.
- On first launch a guest account tied to your device is created. To keep your journal when changing devices, sign in with your phone number; the confirmation code is sent through Telegram.
- You are responsible for access to your device and confirmation codes. Do not share them.
- One person — one account. We may restrict or delete accounts created to bypass limits.
3. Your content and results
Everything you tell Aish remains yours. You grant us the right to process that content — send it to the models, store it, show it back to you, and create results from it — only to the extent needed to run the app. Details are in the Privacy Policy.
Results (pictures, comics, videos, reflections) are generated automatically from your story. You may use them personally and share them. We do not guarantee that results are unique and we do not claim them, but we also cannot guarantee they can be registered as copyrighted works: the legal status of AI-generated content differs between countries.
Aish may refuse to create a result if the story violates the models' safety rules or the law. Sparks are not deducted, or are refunded, for a refused result.
4. Prohibited use
You may not:
- use the app to create content that breaks the law, violates other people's rights, or app-store rules: sexual content involving minors, incitement to violence, discrimination, harassment, fraud;
- present Aish's results to third parties as medical, legal, or financial advice;
- attempt to extract the source code, bypass limits, automate requests, overload the service, or interfere with its operation;
- give others access to your account or sell Sparks outside the app.
If these rules are broken, we may restrict features or block or delete the account without refunding unused Sparks.
5. Sparks and the Pro subscription
- Sparks are the app's internal unit used to pay for results. Sparks are not money, electronic currency, or a security; they have no cash value, cannot be exchanged for money, and cannot be transferred between accounts.
- Free Sparks are granted every week on both plans and expire at the end of the week. On the Free plan, videos are paid with purchased Sparks only. Purchased Sparks do not expire while the account exists.
- The cost of results in Sparks and the size of grants are shown in the app and on the website. We may change them; changes do not affect Sparks already purchased.
- Pro is an auto-renewing subscription, monthly or yearly. It provides a larger weekly supply of Sparks and longer videos. The subscription renews automatically at the end of each period and the price of the next period is charged until you cancel.
- Free trial. Pro may start with a free trial (currently 7 days). A trial is offered once per person: a repeat subscription starts without it. If you do not cancel before the trial ends, the first period is charged automatically when it ends.
- Cancelling. A subscription bought in the app is cancelled in your App Store or Google Play subscription settings. A subscription bought on the website is cancelled in your account on the website (“Manage subscription”) or through the Paddle receipt email. After cancellation Pro stays active until the end of the period already paid, and no further charges are made.
- Sparks are deducted before a result is created. If the result could not be created through our fault, Sparks are returned to your balance. If only part was created (for example, a shorter video than requested), you receive that part.
6. Purchases and refunds
In the app, purchases are processed by the App Store and Google Play under their terms; refunds for them are requested from Apple or Google.
On the website, our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our website orders: Paddle sells Sparks and the Pro subscription to you, charges your payment method, issues the receipt and invoice, handles returns and payment inquiries, and calculates and remits sales tax or VAT. Paddle's Buyer Terms also apply to these purchases. We never see your card details.

Prices of Sparks and the subscription are comparable across sales channels but may differ by country, currency, and store. The final price is always shown before you pay: in the app store, or at checkout on the website. Taxes are included in the price or added to it according to the store's rules and the laws of your country.
7. Availability and changes to the service
We work to keep Aish stable but do not guarantee uninterrupted availability: maintenance, outages at model providers, and store restrictions happen. We may change features, result formats, and models, and may discontinue the service with at least 30 days' notice and an opportunity to export your dream journal.
8. Limitation of liability
The app is provided "as is". To the extent permitted by law, we are not liable for indirect losses, lost profits, or decisions made on the basis of conversations with Aish or dream reflections. Our total liability under the Agreement is limited to the amount you paid in the last 12 months. These limits do not affect consumer rights that cannot be limited under the law of your country.
9. Termination
You may stop using the app and delete your account at any time — in the app (Profile → Delete account) or by a request through the contact form. We may terminate the Agreement if its terms are breached. When the account is deleted, unused Sparks are void. A subscription bought on the website is cancelled immediately when the account is deleted. A subscription bought in the App Store or Google Play is not: cancel it in your app store, otherwise the store may keep charging it.
10. Changes to the Agreement
We may update the Agreement. The new version is published on this page with its date; we announce material changes in the app. Continuing to use Aish after a change means you accept the new version.
11. Governing law and disputes
The Agreement is governed by the law of the Republic of Kazakhstan unless mandatory rules of your country of residence provide otherwise. Disputes are resolved by negotiation through the contact form and, failing that, in the courts at the company's location or at your place of residence where consumer-protection law so requires.
